1. In a temporal apportionment (Muhaya'ah), the commencement date and the period of enjoyment of each co-owner shall be determined. If the co-owners disagree thereon, the court shall determine the period it deems appropriate based on the nature of the dispute and the undivided property, and may conduct a draw of lots to determine the commencement time of enjoyment. 2. In a spatial apportionment (Muhaya'ah), the place of enjoyment of each co-owner shall be specified. If the co-owners disagree, the court may draw lots to determine the part to be enjoyed.
