1. If partition in kind is impossible or if it would cause harm or a significant decrease in the value of the property to be partitioned, any of the co-owners may sell their share to another co-owner or may request the court to order its sale in the manner prescribed by law. 2. If the sale of the share proves impossible, this co-owner may request the sale of the entire property in the manner prescribed by law, and the price shall be distributed among the co-owners, in proportion to their respective shares. The court may order that the auction be restricted initially to the co-owners if one of them so requests. 3. In all cases, a request for sale shall not be accepted if it would cause greater harm to the remaining co-owners, and a new request for sale from the same person shall not be admitted before the lapse of one year from the date of the rejection of the previous request or from the date the harm ceased, whichever is earlier.
