Article 1009

Book Two: Nominate Contracts · Section Five: Suretyship Contract · Chapter Two: Effects of the Suretyship Contract

1. The creditor may not have recourse against the surety alone except after having recourse against the debtor. 2. The creditor may not levy execution against the surety’s property until after exhausting all the debtor's property, unless the surety is jointly and severally liable with the debtor, or unless the law or the agreement provides otherwise. 3. The surety shall raise the defence before the court as stipulated in this Article.
