Article 1003

Book Two: Nominate Contracts · Section Five: Suretyship Contract · Chapter Two: Effects of the Suretyship Contract

1. The surety shall be discharged upon the discharge of the debtor, and they may invoke all the defences that the debtor may raise. 2. If the defence raised by the debtor is their lack of capacity, and the surety was aware of this at the time of contracting, they may not invoke this defence.
