Article 280 — Article (280)

Part Two: Attachments · Chapter Four: Attachment of movable property in the hands of a Debtor

1. The Judgment Creditor may proceed with the execution if the Court passes judgment striking out the action for recovery or if it is regarded as being void ab initio or judgment is passed ruling that it be so treated. They may also proceed with the execution if judgment is passed in the action dismissing it or ruling that there is no jurisdiction or disallowing it, or ruling that the statement of claim is void or that the litigation has lapsed, or accepting abandonment thereof. 2. The Judgment Creditor shall proceed with the execution notwithstanding that the judgments referred to in Clause (1) of this Article are appealable.
