The Judges of the Courts of First Instance and the Courts of Appeal and the Members of the Public Prosecution may be sued in the following circumstances: 1. If a fraud, a deceit or a flagrant professional mistake has been committed by the Judge concerned or Member of the Public Prosecution. 2. In the other circumstances in which the law provides for the liability of the Judge concerned and for their obligation to pay damages.
