Scope and exclusions
Applies to
Subject to Article 15 of the 59/2024 regime, applies to guarantees expressly undertaken by the Ministry of Finance where the relevant public debtor has failed to perform by the contractual deadline and the creditor has complied with the prescribed claim conditions and periods.
Limitations and exclusions
The Decision does not itself create a guarantee or expand its amount, term or beneficiaries beyond the relevant contract; a claim may fail where the guaranteed obligation has expired, is invalid or is not due, and in the specified cases involving loss of security, impossibility or limitation.
