Guardianship shall be denied, and the tutor shall be terminated by a decision from the competent court in either of the following two cases: 1. If one of the conditions required for the guardian or trustee is not met. 2. If the guardian or trustee fails to fulfil the duties of guardianship or trusteeship, or is unable to fulfil them.
