Evidence in Civil and Commercial Transactions

Article 46 — Article (46)

Part 3: Documentary Evidence

1.The party who claims that an instrument is forged may withdraw his claim before the completion of the investigation procedures. He may not claim forgery of the instrument following such withdrawal. 2.The party against whom the claim of forgery is raised may put an end to the procedures of investigation into the forgery, whatever the status of the procedures is, by waiving his insistence on the instrument claimed to be forged. In this case, the court may order either to seize or retain the instrument if so requested by the person claiming forgery for a legitimate interest.
