1. Where the Major Criminal Court is convinced that the underlying act, as described in the transfer decision and before being examined at a hearing, constitutes a misdemeanor or a felony punishable by a determinate prison sentence, it shall decide that its lacks the jurisdiction and shall transfer the case to the competent court. 2. If the Minor Criminal Court is convinced that the underlying act constitutes a felony punishable by the death penalty or life imprisonment, it shall decide that it lacks the jurisdiction and shall transfer the case to the Major Criminal Court. 3. If the Minor Criminal Court is convinced that the underlying act, as described in the decision of transfer to criminal trial and before being examined at a hearing, constitutes a misdemeanor, it shall decide that it lacks the jurisdiction and shall transfer the case to the misdemeanor court.
