The following shall be exempted from the penalty: 1. Any witness who - by saying the truth - would conceivably expose himself to serious prejudice to his liberty or honour, or would expose his spouse, even divorced, or any of his ascendants, descendants, siblings, or in-laws of the same degrees. 2. Any witness who, having announced to the court his name, surname and nickname, was not supposed to be heard as a witness or was supposed to be warned that, if this were his wish, he would have been entitled to abstain from bearing witness. 3. If in the two above cases, the false testimony has exposed another person to any legal prosecution or conviction, the witness shall be punished with incarceration for a period not less than (6) six months.
