Article 169 — Article (169)

Book Two: Commercial Obligations and Contracts · Part Three: Commercial Mortgage

1. Where a mortgage is effected on a fungible item, it shall remain in place even if the mortgaged item has been replaced by another item of the same kind. 2. Where the mortgaged item is non-fungible, the mortgagor may replace it by another item; provided that the same is agreed on in the mortgage contract and that the mortgagor accepts the substitute, without prejudice to the rights of a bona fide third party.
