Article 334

1. If the debtor is required to preserve a thing, to manage it, or to exercise care in the performance of their obligation, they shall have fulfilled the obligation if they exert in its performance all the care of an ordinary person, even if the intended result is not achieved, unless the law or the agreement provides otherwise. 2. In all cases, the debtor remains liable for fraud or gross fault.
