1. Unfairness is the lack of equivalence between the rights acquired by a contracting party under the contract and the obligations they bear thereunder. 2. Unfairness may be either minor or gross. Minor unfairness is that which falls within the assessment of valuers, and gross unfairness is that which does not fall within the assessment of valuers.
