Article 1401

Book Four: Real Securities · Section Three: Privilege · Chapter One: General Provisions

1. A privilege shall not affect the rights of the possessor of a movable if they act in good faith. 2. For the purposes of Paragraph (1) of this Article, the lessor of immovable property, with respect to the movables located in the leased property, and the hotel proprietor, with respect to the guests' luggage, shall be deemed to be a possessor. 3. If the holder of a privilege over a movable fears its loss or disposition, they may request that it be placed under judicial sequestration.
