Article 1396

Book Four: Real Securities · Section Two: Possessory Pledge · Chapter Four: Extinction of the Possessory Pledge

A possessory pledge shall be extinguished by one of the following reasons: 1. The full extinction of the secured debt, provided that it shall revive if the cause of its extinction ceases to exist, without prejudice to the rights lawfully acquired in good faith by third parties during the period between the extinction of the debt and its revival. 2. The express or implied waiver by the pledgee creditor of their right to the pledge. 3. The merger of the right of pledge with the right of ownership in the same person, provided that it shall revive if the cause ceases with retroactive effect. 4. Perishing of the thing or the extinction of the pledged right.
