Article 1316

Book Four: Real Securities · Section One: Mortgage · Chapter Two: Effects of the Mortgage · Part One: Effects of the Mortgage between the Contracting Parties · Second: Effects of a Mortgage with Respect to the Mortgagee

1. The mortgagee has the right to satisfy their debt from the mortgaged immovable property upon the maturity of the debt, according to their rank, and after following the legal procedures before the competent court, in accordance with the applicable legislation. 2. If the proceeds of the immovable property do not satisfy the mortgagee's debt, they may have recourse for the remainder of their debt against the debtor's assets as an unsecured creditor.
