Article 113 — Article (113) Court Having Jurisdiction to Decide on Motions for Release, Detention or Provisional Electronic Monitoring

1. If the Accused is taken to court, the decision to release him, if he is detained, to detain him, if he is released, or placing him temporarily under electronic monitoring if he is detained or released, or overturning any such a decision, shall fall with the jurisdiction of the court to which he is taken. 2. In case of a judgment announcing lack of jurisdiction of the court, the court that renders such a judgment shall have jurisdiction to decide on the motion for release, detention or provisional electronic monitoring or the cancellation thereof, until the case is brought before the competent court.
