Проверка контрагента и подписанта

До сделки сверяются CR, licence, authorised activities, legal form, owners, manager и power of attorney. Агент, distributor и customs broker не должны выходить за пределы полномочий.

Incoterms не регулируют всё

Правило Incoterms распределяет delivery, cost и risk по своему периметру, но не определяет title, payment, tax, licence, sanctions, product compliance или dispute forum. Версия правила и named place указываются точно.

Importer of record

Импортёр должен иметь необходимую регистрацию, вид деятельности и доступ к Bayan. Он отвечает за declaration, classification, value, origin, permits и payments. Если importer предоставляет distributor, договор распределяет документы, cost, audits и ответственность.

Декларация через Bayan

Официальная процедура требует создать declaration, выбрать правильное описание, приложить документы и permits и уплатить налоги/сборы. Customs указывает commercial invoice, manufacturer's country-of-origin certificate и exporter declaration среди основных документов.

HS code, origin и customs value

Classification определяет duty и ограничения; origin — право на preference и marking; customs value обычно начинается с transaction documents и применимых корректировок. Для неопределённости Customs предлагает advance ruling до импорта.

Restricted goods и product approvals

Customs публикует карту permits министерств и органов для telecom equipment, chemicals, food, medicines, vehicles, construction products, precious metals, drones и других категорий. Одному товару могут требоваться несколько approvals.

Free zone и mainland — разные этапы

Ввоз в free zone, хранение, processing, re-export и выпуск на внутренний рынок квалифицируются отдельно. Продажа с территории зоны в Oman customs territory обычно запускает mainland customs, VAT и licensing analysis.

Dispute clause и доказательства

Governing law, court/arbitration, seat, language, notice и interim relief выбираются до поставки. При споре решающими становятся signed contract, amendments, inspection, shipping, customs, bank и communication records.
