1. If the Accused fails, without an acceptable excuse, to fulfill any of the obligations imposed on him under Article [109] hereof, the bail bond shall become the property of the government with no need for a court judgment to that effect. 2. The amount of bail shall be refunded in full if either a non-suit order is issued on the criminal action or the Accused is found innocent. 3. The court may, in all instances, decide that the amount of bail or any portion thereof be refunded, or that the bail bondsman be relieved of his undertaking.
