1. Where the buyer fails to pay any installment of the price agreed, the seller may, after notifying the buyer, ask for rescission with damages if justified. However, if it is revealed to the court that the buyer has executed the larger part of his obligation, the court may grant him a time limit for payment and reject the rescission if he makes the repayment within the prescribed time limit. 2. Where a judgment of rescission is rendered, the buyer shall return the item sold to the seller and the seller shall return to the buyer the installments received less charges equivalent to a rent for the utilization thereof, in addition to an indemnity against the damage sustained by the item sold due to abnormal use thereof; unless there is an agreement to the contrary in the sale contract and provided that the total sum received by the seller does not exceed the original price sum with its interest.
