1. Where the buyer refuses to take delivery of the item sold, the seller may apply to the court to establish the status of the same and grant him permission to sell same under the court supervision after the lapse of a time limit fixed by it and notified to the buyer. However, the court may order that highly perishable items may be sold without delay and without notice. 2. The total value of the sale shall be deposited in the treasury of the court, after deducting therefrom all the expenses incurred by the seller until the dispute between him and the buyer is settled.
