01
One asset - several layers of protection
- Name / logo
- Trademark, trade name, domain and unfair competition
- Invention
- Patent or utility model when criteria are met
- Appearance
- Industrial design
- Code / content
- Copyright, contract and access controls
- Know-how
- Trade secret, NDA and information security
- Origin
- Geographical indication if there is a connection with the territory
02
We check the brand in Arabic and English
Company name, domain and trademark are different objects. Before the launch, clearance is carried out for the word, logo, transliterations and semantic equivalents in the required classes. Registration of a commercial name does not replace trademark registration.
Verification and application must precede signage, packaging, app listing, distributor launch and promotional costs.
03
Trademark registration
- 01Clearance
Registry, affinity, classes and local values.
- 02Applicant
The correct owner in the group structure.
- 03Filing
National application or Madrid designation.
- 04Examination
Formal/substantive review and responses to the department.
- 05Maintenance
Use evidence, renewal, changes and monitoring.
04
Patent: novelty before disclosure
The law requires novelty, innovative step and industrial applicability. Publication, exhibition, pitch or transfer without an NDA prior to filing can ruin the novelty. For an international project, national filing and PCT routes, priority deadlines and commercialization markets are compared.
- Before filing
- Invention capture, inventors, owner and prior art
- Specification
- Claims, descriptions, examples and drawings
- Route
- Oman national phase / PCT strategy
- Employment
- Service invention and compensation rules
- Freedom to operate
- Separate from patentability and requires a search for third party rights
05
Industrial design
The appearance of a product may be protected separately from its function and brand. Before disclosure, images, variants, creator, assignment and priority are recorded; technically determined characteristics and exceptions are analyzed separately.
06
Copyright and digital assets
Protection of text, photographs, video, software, architecture and other works begins with proof of the author, date and transfer of rights. Repository access is not equal to ownership; the contract with the employee, agency and freelancer must directly describe the rights, territory, term and further processing.
07
Trade secret exists only under the regime
- Identify
- Specific list of confidential information
- Access
- Need-to-know, roles, MFA and logs
- Contract
- NDA, employment, vendor and clean-room terms
- Marking
- Classification and handling rules
- Exit
- Return, deletion, access revocation and reminders
- Response
- Investigation, preservation and interim relief
08
Who owns the IP in the group
Founder, employee contractor, local company and foreign holding should not simultaneously consider one asset to be theirs. Chain of title is confirmed by creation records, employment terms, assignments, corporate approvals and registry entries.
09
Licensing and technology transfer
Scope, territory, field, exclusivity, quality, sublicensing, improvements, royalty, tax, audit and termination are consistent with the registered right. The law provides for the recording of assignment and license in the Registry; for certain rights, the absence of a record affects the action against third parties.
10
Enforcement: market, border and court
The strategy combines monitoring, cease-and-desist, platform takedown, customs measures, preservation, civil claim and, if applicable, criminal route. The law provides for border measures for imported, exported, transit and transshipped goods and judicial appeal of customs decisions.
